Terms & Conditions of Sale

These Terms and Conditions of Sale apply to design services purchased through the Primepixel online store. The seller is DBAICH OUAHTIT ANASS, Entrepreneur individuel, operating the public-facing brand Primepixel.

Placing an order requires the customer to review the selected service, price, deliverables, turnaround information and these terms. Completion of checkout constitutes acceptance of the contractual terms displayed before payment, subject to any mandatory rights that cannot lawfully be excluded.

Customers must have legal capacity to enter into the contract. A person ordering on behalf of an organisation confirms that they are authorised to bind that organisation.

Primepixel provides graphic design and UI/UX services, including logo design, brand identity, landing-page design, app-screen design, social-media assets and print collateral. The exact deliverables, revision allowance, file formats and estimated turnaround are stated on the relevant service page.

Product images and mockups illustrate the intended type of work and presentation. They do not guarantee an identical creative result because each project is developed from the customer’s brief, content, references and business requirements.

An order is considered received when payment is successfully authorised and an order confirmation is issued. Design work does not begin until Primepixel also receives a complete brief and all materials reasonably required for performance.

Primepixel may decline or cancel an order before work begins where the request is unlawful, misleading, outside the advertised scope, technically impracticable, conflicts with third-party rights or cannot reasonably be completed. Any amount paid for work not begun will be refunded using the original payment method.

Prices are displayed in euros (EUR). Before payment, the product page, cart and checkout display the selected service name, price, subtotal and total. The price shown at checkout is the price payable for the selected package unless an obvious technical or pricing error has occurred.

Any applicable tax treatment will be shown at checkout and on the invoice. The customer should confirm the displayed total before payment.

Payment is due in full at checkout using an available payment method. Payment processing is handled by Shopify and the payment providers made available during checkout. Primepixel does not receive or store the customer’s complete payment-card credentials.

An invoice or payment record will be provided electronically using the information supplied by the customer. Customers are responsible for providing accurate billing details.

The customer agrees to:

• provide an accurate and sufficiently detailed brief;
• provide required text, logos, images, brand assets and technical information in usable form;
• respond to questions and revision requests within a reasonable time;
• review proofs carefully before approval or final delivery;
• ensure that submitted materials may lawfully be used for the project; and
• avoid requesting content that is unlawful, deceptive, discriminatory or infringes third-party rights.

The customer remains responsible for the accuracy of names, prices, claims, spelling, legal statements and other content supplied for inclusion in the work. Primepixel may rely on the information provided.

Delays caused by missing information, late feedback, changed instructions or inaccessible third-party systems may extend the delivery estimate.

Turnaround periods are estimates stated in business days and begin only after payment, receipt of a complete brief and receipt of all required materials. They do not include customer response time.

The number of included revision rounds is stated on the service page. A revision means a reasonable adjustment to the selected direction within the original brief. A new concept, a changed business objective, substantial new content, extra pages or screens, or work outside the purchased deliverables may require an additional fee and revised schedule.

Final files are delivered digitally by email, download link, shared workspace or another reasonable electronic method. No physical shipping is included for design-service orders unless a separate physical product expressly states otherwise.

The customer should download and securely retain final files after delivery. Primepixel does not guarantee indefinite storage of project files after completion.

A consumer purchasing a service at a distance generally has fourteen days from conclusion of the contract to exercise the statutory right of withdrawal, unless a lawful exception applies.

Where the consumer asks Primepixel to begin performance before the end of that period, work will begin only after the consumer’s express request. If the consumer later withdraws before the service has been fully performed, the consumer may be required to pay an amount proportionate to the work already performed, where permitted by law.

Once a service has been fully performed following the consumer’s express prior request and acknowledgement that the right of withdrawal will be lost after full performance, the right of withdrawal may no longer apply.

To exercise the right, the consumer must send an unambiguous statement before the deadline to support@primepixel.fr. The message should identify the customer, order number, service ordered and decision to withdraw.

Drafts, unused concepts, working files, methods, templates, tools and pre-existing materials remain the property of Primepixel or their respective licensors unless the service page expressly states otherwise.

Rights in the approved final deliverables are transferred or licensed only after full payment and in accordance with the deliverables stated on the service page. Any third-party fonts, stock assets, plugins, software or licences remain governed by their own terms and may require separate customer licences.

The customer warrants that it has the necessary rights and permissions for all materials supplied to Primepixel. The customer is responsible for trademark searches, legal clearance and registration of any final brand name or logo unless a separate legal service is expressly agreed.

Primepixel will not publish confidential project material. Portfolio use should be agreed with the customer where the work has not already been made public.

Primepixel will perform the purchased service with reasonable professional care. Nothing in these terms excludes liability or legal remedies that cannot lawfully be excluded.

To the extent permitted by law, Primepixel is not responsible for indirect loss, lost profit, lost opportunity, customer-supplied errors, unauthorised use of third-party material, changes made after delivery or the performance of third-party platforms, printers, developers or service providers.

A complaint should first be sent to support@primepixel.fr with the order number and a clear explanation of the issue.

These terms are governed by French law, without depriving consumers of mandatory protections available under the law of their habitual residence. Any dispute will be handled by the competent court determined under applicable law.
